1. Ownership & Usage Rights
All photographs, video, and other media produced by Cody James Crompton / Highline Photography remain the copyrighted property of the photographer.
Upon full payment, the client receives a non-exclusive, non-transferable license to use the delivered media to market the specific property for which it was commissioned. Unless otherwise agreed in writing, the license remains valid for the duration of the property's active listing or marketing campaign and ends when the property is sold, leased, withdrawn, or the listing agreement is terminated.
Media may not be sold, transferred, sublicensed, or provided for the independent marketing use of third parties—including subsequent listing agents, builders, designers, stagers, contractors, property owners, or other businesses—without permission from Highline Photography. Extended or commercial-use licensing is available upon request.
2. Scheduling & Availability
A minimum of 18 hours' notice is required for online booking.
Saturday appointments are available by request and are subject to a $100 Weekend Premium.
Dedicated on-site sunset/twilight sessions are generally available on Fridays and are subject to scheduling and weather conditions.
Appointment durations are estimates based on the service ordered and property information provided at booking. Properties or projects requiring substantially greater coverage than booked may require additional time and fees.
3. Cancellation & Rescheduling
Each appointment reserves a dedicated block within a limited-volume photography schedule.
At least 24 hours' notice is required to cancel or reschedule an appointment. Appointments cancelled or rescheduled within 24 hours of the scheduled start time may be subject to a fee equal to 20% of the booked session total.
Highline Photography may reschedule exterior or weather-dependent services when conditions would prevent safe operation or reasonable professional results. Weather-related decisions are made at the photographer's discretion.
4. Property Information, Size & Pricing
Pricing and appointment duration may be based on the property's square footage, acreage, structures, requested coverage, and other information supplied by the client.
The client is responsible for providing reasonably accurate property information when booking. Highline Photography may verify property size or characteristics using available MLS, tax, appraisal-district, or other property records when appropriate.
If the property is materially larger, contains additional structures, acreage, or requires substantially more coverage than represented at booking, the order may be adjusted to the appropriate service tier and additional charges may apply.
Floor-plan and scanning services, including CubiCasa, may incur additional processing or service charges for unusually large properties. Any applicable third-party charges or size-based upgrades may be added to the final order.
5. Property Preparation, Access & On-Site Conditions
Properties should be clean, accessible, and camera-ready at the scheduled appointment time. The photographer is not responsible for cleaning, staging, moving furniture, extensive decluttering, landscaping, or other property preparation.
Reasonable minor adjustments may be made at the photographer's discretion, but significant preparation or delays may reduce the amount of photography completed during the scheduled appointment.
The client is responsible for arranging property access and communicating relevant access instructions before the appointment. Additional charges may apply when a return trip is required because a property was inaccessible, unprepared, incorrectly represented, or otherwise unable to be photographed as scheduled.

6. Property & Boundary Information
For land, acreage, commercial properties, or any project requiring property or boundary lines, the client is responsible for providing accurate boundary information before the shoot.
Surveys, plats, CAD/property IDs, maps, screenshots, or other available reference material should be provided by replying to the order confirmation email before the appointment.
Highline Photography does not independently determine, survey, or certify legal property boundaries. Any boundary lines shown in delivered media are visual representations based on information supplied by the client or readily available reference material and should not be relied upon as a legal survey.
Unless otherwise specified in the purchased service, boundary-line graphics are limited to the included number of finished images. Additional boundary-line images or extensive revisions may incur additional fees.
7. AI & Digital Visualization
Highline Photography may provide images created or modified using artificial intelligence or other digital techniques, including virtual staging, landscaping, exterior enhancements, twilight conversions, object removal, and other visualizations.
These images may depict proposed, enhanced, or conceptual conditions that do not currently exist at the property. Materially altered images may be identified as AI VISUALIZATION, VIRTUAL STAGING, or with similar disclosure.
When appropriate, Highline Photography will also provide an unaltered photograph showing the property's actual photographed condition.
The client is responsible for determining whether and how digitally altered media may be used in the applicable MLS, brokerage, advertising platform, publication, or marketing channel and for complying with applicable advertising and disclosure requirements. Highline Photography does not guarantee that altered media will be accepted by any MLS or third-party platform.
Clients should not use digitally altered media in a manner that misrepresents material facts, conceals known defects, or otherwise creates a misleading impression of the property.
8. Digital Cleanup & Object Removal
When purchased or included with a service, digital cleanup may be used to reduce reasonable visual distractions such as temporary objects, neighboring trash cans, vehicles, minor landscape imperfections, and similar elements.
Digital cleanup is not a substitute for physical property preparation and does not include unlimited retouching or reconstruction.
Highline Photography will generally avoid removing or materially altering permanent structures, significant property features, utility infrastructure, or known defects in standard listing photography. Requests requiring substantial alteration may instead be treated as AI or digital visualization and disclosed accordingly.
9. Floor Plans & Third-Party Measurements
Floor plans, room dimensions, square-footage estimates, and similar measurements produced through CubiCasa or other third-party services are provided for marketing and informational purposes only.
Measurements are approximate and should not be relied upon for appraisal, construction, architectural, legal, or other purposes requiring independently verified measurements.
10. Delivery, Payment & Revisions
Standard MLS photography is generally delivered within 24 hours following the completed session. Additional marketing assets—including video reels, virtual staging, AI visualization, advanced retouching, floor plans, and other specialty products—may be delivered separately at the earliest available completion time.
Turnaround times may vary based on project scope and production requirements. Large properties, commercial assignments, custom-quoted projects, unusually extensive coverage, or sessions requiring substantial post-production may require additional delivery time. When possible, an estimated delivery schedule will be communicated for projects expected to fall outside the standard MLS photography turnaround.
Full payment is required before final unwatermarked media is released for download.
Delivered media reflects Highline Photography's professional editing style and judgment. Reasonable corrections for editing errors or issues attributable to Highline Photography may be requested. Additional editing, alternate treatments, newly requested services, extensive revisions, or changes outside the original scope may incur additional fees.
A return visit requested because of property condition, missing access, incomplete preparation, changes made after the original session, or additional coverage not included in the original order may require a new appointment and return-trip fee.
11. Photo Counts & Coverage
Unless a specific quantity is expressly guaranteed in writing, stated photo counts are estimates, ranges, or maximum allowances and do not represent a guaranteed number of delivered images.
Highline Photography determines the final image selection and quantity based on the property's size, layout, features, condition, and the coverage reasonably necessary to market the property. The photographer is not required to create or deliver redundant, repetitive, or unnecessary images solely to reach a stated maximum.
Requests for additional photographs or coverage after the completed session that were not reasonably necessary for the original scope may require additional editing fees or a return visit and applicable return-trip fee.
12. Client Acceptance
By submitting an order or approving a booking with Highline Photography, the client acknowledges and agrees to these Terms of Service and accepts responsibility for providing accurate booking information and using delivered media in accordance with applicable laws, MLS rules, brokerage policies, and third-party platform requirements.
